By creating an account with LSTV, accessing our website, using any of our online or offline services, or participating in any LSTV-related activities, you agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms and conditions that may apply to specific services or features. If you do not agree to these terms, you must not use our services.



Service Description:
LSTV provides a comprehensive platform offering various online services including but not limited to content hosting, social networking, digital commerce, streaming services, and offline services including software, events, and consultations. Our services may evolve and expand over time.




Eligibility:
You must be at least 13 years old to use our services. Users between 13-18 years old must have parental consent. By using our services, you represent that you meet these age requirements and have the legal capacity to enter into this agreement.




Account Responsibilities:
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.




Permitted Use:
You may use our services for lawful personal or commercial purposes in accordance with these terms. You agree to use our services responsibly and in good faith, respecting the rights of other users and third parties.




Prohibited Activities:
• violate any applicable laws or regulations;
• infringe upon intellectual property rights;
• engage in harassment, hate speech, or discrimination;
• distribute malware or engage in unethical hacking;
• spam or send unsolicited communications;
• impersonate others or provide false information;
• interfere with our services or infrastructure;

User Content:
You retain ownership of content you submit but grant LSTV a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your content in connection with our services. You represent that you have all necessary rights to grant this license and that your content does not violate any third-party rights.




Adult Content:
Sexual adult content is permitted in designated areas provided it is properly marked, complies with all applicable laws, and does not contain extreme violence or illegal content. All adult content must be appropriately tagged for content filtering. Any depiction of minors in NSFW contexts, including fictional representations, is strictly prohibited as per German law. Distribution of adult content involving anyone under 18 is prohibited and will be reported to authorities.




Content Moderation:
We reserve the right to review, moderate, remove, or restrict access to any content at our discretion. We may use automated systems and human review for content moderation. We are not obligated to monitor content but may do so to enforce these terms and applicable laws.




Intellectual Property:
LSTV and its licensors own all rights in our services, including software, designs, trademarks, and proprietary content. You may not copy, modify, distribute, or create derivative works of our intellectual property without explicit written permission.




Payment and Refunds:
For paid services, you agree to pay all applicable fees. Payments are non-refundable unless required by law or specified in our refund policy. We reserve the right to change pricing with notice. Failure to pay may result in service suspension.




Service Availability:
We strive to maintain service availability but do not guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, updates, or technical issues. We are not liable for service interruptions or their consequences.




Termination:
Either party may terminate this agreement at any time. We may suspend or terminate your access immediately for violations of these terms, illegal activity, or other reasons at our discretion. Upon termination, your right to use our services ceases, though certain provisions of these terms will survive.




Privacy and Data Protection:
We process your personal data according to our Privacy Policy and applicable data protection laws including GDPR. By using our services, you consent to our data practices as described in our Privacy Policy.




Third-Party Services:
Our platform may integrate with or link to third-party services. We are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their respective terms and policies.




Indemnification:
You agree to indemnify and hold harmless LSTV, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or infringement of third-party rights.




Limitation of Liability:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LSTV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO LSTV IN THE 12 MONTHS PRECEDING THE CLAIM.

OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE ACCURACY, RELIABILITY, OR AVAILABILITY OF OUR SERVICES OR USER CONTENT.




Force Majeure:
We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, government actions, internet failures, or other force majeure events.




Dispute Resolution:
Any disputes arising from these terms or our services shall be resolved through binding arbitration in accordance with Czech arbitration law, except where prohibited by local law. Class action lawsuits are waived where legally permissible.




Governing Law and Jurisdiction:
These terms are governed by Czech law and German law where applicable. Our primary servers are located in Germany. By using our services, you agree to comply with all applicable Czech, German, and local laws and regulations. Courts in Prague, Czech Republic have exclusive jurisdiction for any legal proceedings.




Severability:
If any provision of these terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect. Invalid provisions shall be replaced with valid provisions that most closely reflect the original intent.




Changes to Terms:
We may update these Terms of Service at any time. Material changes will be communicated through our platform or via email with at least 30 days notice. Continued use of our services after changes become effective constitutes acceptance of the revised terms.
